Terms of Service

These Terms govern your use of the DRV.club mobile application and the drv.club website (together, the "Service"), operated by DRV.club ("we", "our", "us"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be at least 13 years old (or the minimum age in your country of residence) to use the Service, and you must hold a valid driver's licence in the jurisdiction where you drive. You are solely responsible for complying with the laws of the road wherever you use DRV.club.

2. Driving safety — read carefully

DRV.club provides navigation, convoy coordination, hazard alerts, and community tools. It is an assistive Service, not a substitute for a licensed driver's judgement, the rules of the road, or official traffic signage. You agree that:

• You will not interact with the app in a way that distracts from driving.
• You will obey all posted speed limits, traffic signs, and local laws, even if the app suggests otherwise.
• You will not rely on DRV.club as the sole source for emergency response — our crash detection and SOS contact features are best-effort, not a certified safety system.
• Track day, race, and high-performance driving features are intended for use on closed circuits only. Do not use them on public roads.

3. Your account

You are responsible for the activity on your account. Keep your credentials confidential. Notify us at support@drv.club if you suspect unauthorized access.

4. Acceptable use

You agree not to:

• Use the Service to harass, threaten, or harm any person.
• Upload content that is illegal, defamatory, infringing, or unsafe.
• Post content that promotes reckless driving on public roads (street racing, dangerous stunts, evading law enforcement, etc.).
• Scrape, reverse-engineer, or attempt to access non-public APIs.
• Interfere with other users' access to the Service.
• Use the Service in violation of any applicable law or regulation.

We may remove content or suspend accounts that violate these rules, with or without notice depending on severity.

5. Your content

You retain ownership of content you post (car photos, drives, posts, comments). By posting you grant us a worldwide, non-exclusive, royalty-free licence to host, display, distribute, and adapt your content for the purpose of operating and promoting the Service. This licence ends when you delete the content or your account, except for copies already shared with other users or required for legal compliance.

6. Subscriptions and in-app purchases

Some features are gated behind a premium subscription. Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date, managed through your Google Play account. Pricing, refunds, and renewal terms are governed by Google Play's rules in addition to these Terms.

7. Third-party services

DRV.club relies on third-party services (Google Firebase, Mapbox, LiveKit, Sentry, identity providers). Their respective terms and privacy policies apply to data they receive. We are not responsible for the availability or accuracy of third-party content (including map data, traffic data, and external links).

8. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy of map and traffic data, uninterrupted availability, or that crash detection or SOS contact notification will reach emergency services or contacts in time.

9. Limitation of liability

To the maximum extent permitted by law, DRV.club, its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of the Service. Our total liability for any claim arising out of these Terms will not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) US$100.

10. Indemnity

You agree to indemnify and hold harmless DRV.club from any claim arising out of your content, your driving, or your violation of these Terms.

11. Termination

You may stop using the Service or delete your account at any time (Settings → Account → Delete Account). We may suspend or terminate access if you violate these Terms or if continued operation creates safety, legal, or technical risk. Sections that by their nature should survive (your content licence to third parties, liability limits, indemnity, governing law) will survive termination.

12. Changes to the Terms

We may update these Terms. Material changes will be announced in-app or by email at least 14 days before they take effect. Continued use after the effective date means you accept the changes. If you do not agree, please stop using the Service.

13. Governing law

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws principles. Disputes will be resolved exclusively in the competent courts of Tel Aviv-Yafo, Israel, except where mandatory consumer-protection laws of your country grant you the right to bring proceedings in your local courts.
